Terms and Conditions for GJ Landscaping

Introduction

These Terms and Conditions govern the relationship between you, the client, and GJ Landscaping (“we,” “us,” or “our”). By availing of our services, you agree to abide by the terms outlined herein.

Services

We offer a range of landscaping services as outlined on our website and as agreed upon during the estimation process. All services will be provided with professionalism, skill, and care in accordance with industry standards.

Estimates and Payments

All project estimates provided by us are free of charge and come without obligations. Once an estimate is agreed upon, the terms of payment will be discussed. Any changes or additional work beyond the initial agreement may incur additional costs.

Scheduling and Delays

We aim to complete all projects within the specified timeframe. However, delays due to weather, unforeseen site conditions, or other external factors may affect the project timeline.

Cancellation

Should you wish to cancel our services after the commencement of work, you may be liable for any work completed up to the point of cancellation and any costs associated with halting the project.

 Liability

GJ Landscaping is fully insured. We will not be liable for any accidental damage to property or injury to individuals not directly related to negligence on our part.

Warranties

Any warranties or guarantees related to our services will be discussed and agreed upon before the commencement of work.

Changes to Terms

We reserve the right to update these Terms and Conditions at any time. Changes will be communicated to existing clients as necessary.

Scope of Work

The scope of the services provided by GJ Landscaping will be agreed upon in writing before commencement. Any changes or additions to the scope of work may result in additional charges.

Confidentiality

All discussions, documents, and information provided by the client are considered confidential unless explicitly stated otherwise.

Ownership of Materials

All designs, drawings, and related materials created by GJ Landscaping remain our intellectual property. Reproduction or sharing without our written consent is prohibited.

Project Delays

While we aim to complete all projects within the specified timeframe, GJ Landscaping is not responsible for delays caused by factors beyond our control, including but not limited to:

• Inclement weather
• Delays in material delivery
• Unforeseen issues with the site or existing structures

Payments

Payments are due as per the agreed schedule. Failure to make payments on time may result in a halt in work and potential additional fees ($200 per month).

Termination

Either party may terminate the agreement with written notice. If terminated by the client, the client is responsible for payment for all services rendered up to the point of termination.

Warranty

GJ Landscaping provides a limited warranty on our work for a period defined in the agreement. This warranty does not cover damages due to regular wear and tear, improper care, or external factors (like natural disasters).

Limitation of Liability

GJ Landscaping's liability for any claim, loss, or injury arising from our services is limited to the amount paid for the services. We are not liable for indirect or consequential damages.

Indemnification

The client agrees to indemnify and hold harmless GJ Landscaping and its employees against any claims, damages, or legal fees resulting from the client's breach of these terms or misuse of our services.

Governing Law and Jurisdiction

These Terms and Conditions are governed by the laws of The State of Washington. Any disputes arising out of these terms shall be resolved in the courts of [Your Jurisdiction].

Entire Agreement

These Terms and Conditions, along with any signed agreement between GJ Landscaping and the client, represent the entire agreement between the parties and supersede all prior discussions or agreements.
